As you’re aware, the beef processor Westland Beef recently issued a recall for nearly 145 million pounds of beef, resulting in further recent direction from USDA for food manufacturers with processed products containing any amount of Westland Beef. The USDA has determined that the risk of any human harm from this beef is remote. Today, I want to provide you with an update from ConAgra Foods regarding our products and the steps we are taking to fully understand the scope of how our products may be impacted.

Since learning about the animal welfare violations for which Westland Beef has been implicated, we have been conducting our own investigation regarding any potential impact on ConAgra Foods products. At this time, we can tell you that:

§ ConAgra Foods (or its suppliers) has sourced a very limited amount of beef from Westland. We calculate that the amount of Westland beef used in our products comprises less than one half of one percent of the total amount of beef we use in our products.
§ Very few ConAgra Foods products made in the past six months include beef sourced from Westland. Although our investigation is still underway, the only ConAgra Foods products that may contain meat from this supplier deal involved very limited production dates.
§ We expect to have an accurate assessment complete by Monday, 2/25/08. At that time, we will provide you detailed information about impacted product and any potential next steps. If we have provided any product to you containing beef sourced from Westland, we will contact you by the end of day Monday with more information on product specifics and next steps.

I want to emphasize that there is nothing more important to ConAgra Foods than the quality, safety and wholesomeness of our products and that we are taking swift action to work with the USDA in this matter. I am available at 402-595-7919 should you need further assistance or have questions.

February 25, 2008 – In accordance with the USDA directive relating to the recent Class II beef recall, we are voluntarily issuing a recovery of Progresso Italian Wedding Soup. Upon learning of the USDA recall, we launched an investigation and learned of a supplier that had sourced beef from this vendor. The USDA has said the health risk is negligible and as such, consumer notification is not required.

No other Progresso or General Mills products are involved.

The products involved in this action are limited to Best if Used By Codes as follows:

1. See's Candies, Inc. of San Francisco, Calif., is recalling 16-ounce bags of See's Candies Semi Sweet Chocolate Chips because the product may contain undeclared traces of milk. People who have an allergy or severe sensitivity to milk run the risk of serious or life-threatening allergic reaction if they consume these products.
The product was distributed through See's owned retail shops in California, Arizona, Nevada, Oregon, Washington, Utah, Colorado, Idaho, Hawaii, New Mexico, and Illinois. Licensees of See's also sold the product in Nebraska, Iowa, Kansas, Michigan, Texas and internationally in Japan and Hong Kong. See's Mail Order department sold small quantities countrywide.
The product is sold in a black and white See's logo flexible bag. This recall applies to all code dates (30757, 31327, 32067, 33157, and 23397). A photo of this product is attached above.
There is one reported allergen reaction attributed to this product.
See's Candies confirmed in its investigation that the product was produced on a line that also produces milk chocolates as a follow-up to a consumer contact.

CALIFORNIA FIRM RECALLS BEEF PRODUCTS DERIVED FROM NON-AMBULATORY CATTLE WITHOUT THE BENEFIT OF PROPER INSPECTION
WASHINGTON, Feb. 17, 2008 – Hallmark/Westland Meat Packing Co., a Chino, Calif., establishment, is voluntarily recalling approximately 143,383,823 pounds of raw and frozen beef products that FSIS has determined to be unfit for human food because the cattle did not receive complete and proper inspection. Through evidence obtained by FSIS, the establishment did not consistently contact the FSIS public health veterinarian in situations in which cattle became non-ambulatory after passing ante-mortem inspection, which is not compliant with FSIS regulations.
Such circumstances require that an FSIS public health veterinarian reassess the non-ambulatory cattle which are either condemned and prohibited from the food supply, or tagged as suspect. Suspect cattle receive a more thorough inspection after slaughter than is customary.
This noncompliant activity occurred occasionally over the past two years and therefore all beef product produced during the period of time for which evidence indicates such activity occurred has been determined by FSIS to be unfit for human consumption, and is, therefore, adulterated.
This recall is designated as Class II due to the remote probability that the beef being recalled would cause adverse health effects if consumed. FSIS made this determination because the animals passed ante-mortem inspection but should have been identified as suspect requiring additional inspection after slaughter to determine if there is evidence of disease, injury, or other signs of abnormalities that may have occurred after ante-mortem inspection.
In July 2007, FSIS issued a final rule “Prohibition of the Use of Specified Risk Materials for Human Food and Requirements for the Disposition of Non-Ambulatory Disabled Cattle.” This rule requires that a case by case disposition must be made by an FSIS Public Health Veterinarian for every animal that becomes non-ambulatory disabled (“downer”) after passing ante-mortem inspection.
The prohibition of downer cattle from entering the food supply is only one measure in an interlocking system of controls the federal government has in place to protect the food supply. The government has multiple safeguards regarding BSE in place and the prevalence of the disease in the United States is extremely low.
Other BSE security measures include the feed ban that prohibits feeding ruminant protein to other ruminants and an ongoing BSE surveillance program that began before the confirmation of the first BSE positive cow in the U.S. in 2003.
As another measure to reduce the risk of potential exposure to consumers, FSIS requires the removal of specified risk materials (SRM) so they do not enter the food supply. Several FSIS line inspectors are stationed at designated points along the production line where they are able to directly observe SRM removal activities.

The products subject to this recall were sent to wholesale distributors nationwide in bulk packages and are not available for direct purchase by consumers. All products subject to recall bear the establishment number “EST. 336” inside the USDA mark of inspection. The products were produced on various dates from Feb. 1, 2006 to Feb. 2, 2008. Companies are urged to check their inventories and hold the products until the recalling firm makes arrangements for final disposition of the products.

Some of the Westland Meat Co. branded products were purchased for Federal food and nutrition programs and, since Jan. 30, 2008, USDA has had an administrative hold on all products from Westland Meat Co. in all of these outlets including, in the National School Lunch Program, the Emergency Food Assistance Program and the Food Assistance Program on Indian Reservations. Based on this Class II recall, officials of the Food and Nutrition Service and Agricultural Marketing Service will work closely with State food and nutrition officials to minimize any disruptions caused by the removal and disposal of recalled Westland Meat Co. products.

FOR IMMEDIATE RELEASE -- Rockville, MD -- February 14, 2008 – Sherwood Brands LLC is voluntarily recalling approximately 400,000 packages of Pokémon® branded "Valentine Cards and Pops™" (Item# 073964209109 and Item# 073964289804), because of reports that metal fragments were found in two lollipops purchased in Florida. There are no reports of injury. People who bite into or swallow a metal fragment could possibly be injured.
The products being recalled are packages of ten and thirty Pokémon branded Valentine cards and lollipops featuring a variety of characters.
Sherwood Brands is advising its distribution network to remove the Pokémon branded Valentine cards and lollipops from the shelves immediately. The product was sold at retailers nationwide.
"Our utmost concern is the safety of our customers. We took immediate action upon learning of this incident and Sherwood is working with the FDA to recall the products," said Amir Frydman, president of Sherwood Brands.

LION PAVILION LTD. of Brooklyn, NY is recalling 8 ounce packages of Grassplot brand Dried Pachyrhizus because they contain undeclared sulfites. Consumers who have severe sensitivity to sulfites run the risk of serious or life-threatening allergic reactions if they consume this product.

The product comes in an uncoded 8 ounce, clear plastic package. The recalled packages of Grassplot brand Dried Pachyrhizus were distributed nationwide. It is a product of China.

The recall was initiated after routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis by Food Laboratory personnel revealed the presence of sulfites in the 8 ounce package of Grassplot brand Dried Pachyrhizus which were not declared on the label. The consumption of 10 milligrams of sulfites per serving has been reported to elicit severe reactions in some asthmatics. Anaphylactic shock could occur in certain sulfite sensitive individuals upon ingesting 10 milligrams or more of sulfites.

No illnesses or allergic reactions involving this product have been reported to date. New York State Agriculture Commissioner Patrick Hooker today alerted consumers that Walong Marketing Inc., located at 95 Caven Point Road, Jersey City, New Jersey 07305 is voluntarily recalling certain People who have severe sensitivity to sulfites may run the risk of serious or life-threatening reactions if they consume this product.
The recalled “UFC Brand Sweet Sugar Palm Fruit” is packaged in a 12-ounce glass container coded 22821702. It was sold in New York State. According to the label, it is a product of Philippines.
Routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis of the product by Food Laboratory personnel revealed the product contained high levels of sulfites which were not declared on the label. The consumption of 10 milligrams of sulfites per serving has been reported to elicit severe reactions in some asthmatics. Anaphylactic shock could occur in certain sulfite sensitive individuals upon ingesting 10 milligrams or more of sulfites.

This product may be contaminated with Clostridium botulinum spores, which can cause Botulism, a serious and potentially fatal food-borne illness.

The sale of this type of fish is prohibited under New York State Agriculture and Markets regulations because Clostridium botulinum spores are more likely to be concentrated in the viscera than any other portion of the fish. Uneviscerated fish has been linked to outbreaks of botulism poisoning. Symptoms of botulism include blurred or double vision, general weakness, poor reflexes, difficulty swallowing and respiratory paralysis.

The recalled Sum Cheong Lung brand Dried Fish comes in an uncoded 12 oz. plastic bag and is a product of China. Dried Fish was sold in New York State.

New Era Canning Company Expands Nationwide Recall Risk of botulism from additional canned vegetable products
The U.S. Food and Drug Administration (FDA) is alerting consumers, food service operators, and food retailers that New Era Canning Company, New Era, Mich., is broadening its nationwide recall of canned vegetable products for a third time because of the potential for its foods to be contaminated with Clostridium botulinum (C. botulinum).
C. botulinum produces the toxin that causes botulism and can cause life-threatening illness or death. The affected New Era products are large institutional-sized cans, weighing between six and seven pounds, of various types of beans, blackeye peas, and asparagus.
To date, no illnesses have been reported to the FDA. However, consumers should not consume these products, even if they appear to be normal, because of the potential serious risk to health. Consumers who have the affected products, or who have used them in recipes, should immediately throw the cans and food away.
The potentially contaminated products are marketed under ten different brand names:

Processors other than New Era may be packing these brands. Only products packed by New Era are subject to the recall, so individuals must check the lot numbers on the bottom of the cans to determine if the product is affected by the recall. Symptoms of botulism poisoning in humans can begin from six hours to two weeks after eating food that contains the toxin. Symptoms may include double vision, blurred vision, drooping eyelids, slurred speech, difficulty swallowing, and muscle weakness that moves progressively down the body, affecting the shoulders first, then descending to the upper arms, lower arms, thighs, and calves. Botulism poisoning also can cause paralysis of the breathing muscles, which can result in death unless assistance with breathing (mechanical ventilation) is provided. Individuals who have these symptoms and who may have recently eaten the products under recall or other food products made with them should seek immediate medical attention.
Any food that may contain the affected products should be disposed of carefully. Even tiny amounts of the C. botulinum toxin can cause serious illness when ingested, inhaled, or absorbed through the eye or a break in the skin. Skin contact should be avoided as much as possible, and hands should be washed immediately after handling the food.
When disposing of these products, double-bag the cans in plastic bags. Make sure the bags are tightly closed, then place in a trash receptacle for non-recyclable trash outside of the home. Restaurants and institutions should ensure that such products are only placed in locked receptacles that are not accessible to the public. This recall is the most recent to result from an ongoing investigation of New Era Canning’s processing plant by the FDA and the Michigan Department of Agriculture. The FDA initiated an inspection of New Era Canning, along with inspections of other low acid canned food manufacturers, following four cases of botulism in consumers who had consumed canned, hot dog chili sauce in the summer of 2007.

The recalled “Sun Ripened Apricots” are packaged in a 12-ounce plastic container, coded Best By: 09/09/08. The product was sold in Indiana, New Jersey, New York, Pennsylvania and Texas. It is a product of Turkey.

Olivier brand Parmesan & Asiago Dip with Garlic & Basil is manufactured by Olivier Olive Oil Products, Inc. of St. Helena, California, which has initiated a voluntary recall of the product.
Clostridium botulinum is a bacterium which can cause life-threatening illness or death. Symptoms of botulism include: general weakness, dizziness, double-vision and trouble with speaking or swallowing. Difficulty in breathing, weakness of other muscles, abdominal distension and constipation may also be common symptoms. People experiencing these problems should seek immediate medical attention. There have been no reported illnesses.
The product was distributed to William-Sonoma retail stores nationwide and to Olivier Napa Valley retail stores located in Truckee and St. Helena, California. Olivier Parmesan & Asiago Dip with Garlic & Basil labeled with the following lot codes are affected by the recall: OPA 34171; OPA 23471; OAP 17271; OAP 17671; OAP 36061; OAP 36161; OPA 33961.
The recalled product is packaged in an 11.76 ounce jar. The lot code information is located on the side of the glass jar where there is no label. Photos of the product are available at www.cdph.ca.gov.
MDA, in cooperation with its federal food safety and industry partners, is conducting recall audits checks ensuring potentially contaminated product is removed from store shelves and disposed of appropriately.

The recall was initiated after routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis by food laboratory personnel revealed the presence of undeclared eggs in Sunnyside peanut cookies in packages which did not declare eggs as an ingredient on the label.

No illnesses have been reported to date in connection with this problem.
